§ 1306 TITLE 6: CRIMES AND CRIMINAL PROCEDURE DIVISION 1: CRIMES AGAINST THE PERSON § 1306. Sexual Abuse of a Minor in the First Degree. (a) An offender commits the crime of sexual abuse of a minor in the first degree if (1) the offender engages in sexual penetration with a person who is under 15 years of age or aids, induces, causes, or encourages a person who is under 15 years of age to engage in sexual penetration with another person; (2) (A) being 18 years of age, the offender engages in sexual penetration with a person who is under 15 years of age; or (B) being 19 years of age, the offender engages in sexual penetration with a person who is under 16 years of age; or (C) being 20 years of age, the offender engages in sexual penetration with a person who is under 17 years of age; or (D) being 21 years of age or older, the offender engages in sexual penetration with a person who is under 18 years of age. (b) Sexual abuse of a minor in the first degree is punishable by imprisonment for not less than 2 years and not more than 30 years, a fine of not more than $50,000, or both.
