§ 2204. Public Defender- Eligibility

TITLE 9: VEHICLE CODE DIVISION 2: REGISTRATION AND LICENSES § 2204. Persons Unqualified for License. An operator’s license shall not be issued to any person: (a) Under the age of 16 years; (b) Determined to be a habitual drunkard or addicted to the use of narcotic drugs; (c) Previously adjudged insane or an idiot, imbecile, epileptic or feeble minded; or (d) Afflicted with or suffering from a physical or mental disability or disease that prevents the person from exercising ordinary control over a motor vehicle while operating it. (e) Who has not successfully completed a Driver’s Education Program, as provided in Article 4 of this chapter, if: (1) The applicant has never been issued an operator’s license by a government under the jurisdiction of the United States or a foreign country; or, (2) The applicant has previously been issued an operator’s license by any governmental jurisdiction, and that license has been suspended or revoked within one year of application for a CNMI operator’s license. Commission Comment: The Commission deleted figures that were mere repetitions of words in subsections (a)(1) and (2) above pursuant to the authority granted by 1 CMC § 3806(e). PL 15-29 took effect on September 26, 2006, and contained title, findings, and global amendment sections, in addition to other amendments and severability and savings clauses; see the comment to 9 CMC § 2202 regarding PL 15-29.
