§ 2251. Public School System

TITLE 7: CIVIL PROCEDURE DIVISION 2: ACTIONS AND SPECIAL PROCEEDINGS § 2251. Other Actions Against the Commonwealth Government. Except as otherwise provided in article 1 of this chapter (commencing with 7 CMC § 2201), actions upon the following claims may be brought against the Commonwealth government in the Commonwealth Trial Court which shall have exclusive original jurisdiction thereof: (a) Civil actions against the Commonwealth government for the recovery of any tax alleged to have been erroneously or illegally collected, or any penalty claimed to have been collected without authority, or any sum alleged to have been excessive or in any manner wrongfully collected under the tax laws. (b) Any other civil action or claim against the Commonwealth government founded upon any law of this jurisdiction or any regulation issued under such law, or upon any express or implied contract with the Commonwealth govern- ment, or for liquidated or unliquidated damages in cases not sounding in tort. Commission Comment: In PL 3-51, the Commonwealth Legislature re- pealed 6 TTC §§ 251(1)(c), 252 and 253 in their entirety, as those sections might apply to the Commonwealth government. Section 4 of PL 6-25, the “Commonwealth Judicial Reorganization Act of 1989,” provides that “[w]herever the term ‘Commonwealth Trial Court’ ap- pears in the Commonwealth Code, it is henceforth to be interpreted and under- stood to refer to the Commonwealth Superior Court.”
