§ 6365. Special Election
TITLE 1: GOVERNMENT DIVISION 6: ELECTIONS § 6365. Special Election. (a) In the case of a permanent vacancy in the office of Delegate, the Governor shall call for a special election to be held within 90 days of the date of the call for election; provided that in the event that a vacancy occurs within six months of the next general federal election, no special election shall be called and the office shall remain vacant. (b) In the event of a tie vote for the office of Delegate, the tie shall be decided by the drawing of lots, under the supervision of the CEC [Commonwealth Election Commission]. Each candidate shall be present at the drawing of lots along with two witnesses. The result of a drawing of lots shall be final and shall not be contestable. Source: PL 16-13, § 2(6365), modified.
