§ 5603. Definitions

TITLE 9: VEHICLE CODE DIVISION 5: RULES OF THE ROAD § 5603. Parking. (a) No person may park or leave standing any vehicle, either attended or unat- tended, upon the main traveled portion of any highway outside of a business or residential district, when it is practicable or possible to leave the vehicle standing off the main traveled portion of the highway. In no event may any person park or leave standing any vehicle, whether attended or unattended, upon any highway unless a clear and unobstructed width of not less than 15 feet upon the main traveled portion of the highway opposite the standing vehicle is left for the free passage of other vehicles on the highway or unless a clear view of the vehicle may be obtained from a distance of 300 feet in each direction upon the highway. (b) Whenever any police officer finds a vehicle standing upon a highway in violation of any provision of this section or of 9 CMC § 5606, he is authorized to move the vehicle, or require the person in charge of the vehicle to move the vehicle, to a position where it may be lawfully parked. (c) Subsection (a) of this section does not apply to the operation of any vehicle which is disabled while on the main traveled portion of a public highway in such manner and to such extent that is impracticable or impossible to avoid stopping and temporarily leaving the vehicle in that position. (d) No person may park a vehicle or permit it to stand, whether attended or unattended, upon a public highway in any of the following places: (1) Within an intersection. (2) On a crosswalk. (3) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless official signs indicate a different length. (4) Within 25 feet of the intersection or curb lines, or if none, then within 15 feet of the intersection of property lines at an intersection of highways. (5) Within 30 feet upon the approach to any official traffic sign located at the side of the highway. (6) Within 15 feet of the driveway entrance to any fire station. (7) Within 15 feet of any fire hydrant. (8) In front of a private driveway, except that the owner of a private drive- way may so park. (9) On a sidewalk. (10) Immediately next to any street or highway excavation or obstruction, nor opposite the same, unless a clear and unobstructed width of not less than 20 feet upon the main traveled portion of the street or highway shall be left free for the passage of other vehicles. (11) On the highway side of any vehicle stopped or parked at the curb or edge of the highway. (e) Except as otherwise provided in this title, every vehicle stopped or parked upon a highway where there are adjacent curbs shall be so stopped or parked with the right-hand wheels of the vehicle parallel with and within 18 inches of the

This paragraph does not apply to a commercial vehicle when loading or unloading merchandise or passengers. (f) The director may provide, by regulation, for the establishment of parallel or angle parking zones and cause highways to be marked with lanes designating parking spaces and requiring vehicles to park within such parking spaces.
