§ 51133. Lease of Public Land; Satisfaction of the Public Trust
TITLE 4: ECONOMIC RESOURCES DIVISION 5: BUSINESS REGULATION § 51133. Lease of Public Land; Satisfaction of the Public Trust. In any action in a court of competent jurisdiction challenging any lease of public land in an economic incentive district as contrary to the public interest, or alleging a breach of the public trust or fiduciary duty in such a lease, the court shall not limit itself to the rentals prescribed by the lease but shall take into account, in de- termining the matter, the public and economic benefit of the use of land. In any such action, any cost/benefit analysis accepted by the Authority pursuant to this Act with respect to the use to be made of the leased land shall be conclusive as to the findings contained therein. Lease of public land in conformance with Section 51121(k) of this Act is prima facie commensurate with the public interest and in satisfaction of the public trust and fiduciary obligations.
