§ 5585. Sampling Activity or Event

TITLE 4: ECONOMIC RESOURCES DIVISION 5: BUSINESS REGULATION § 5585. Sampling Activity or Event. There shall be no limitation on the frequency of sampling activities or events. Sampling activities or events may be conducted at any on-sale or off-sale licensed establishment by the sampling licensee without any further restricting regulations and/or approval not referenced in this provision by the Department of Commerce, Alcoholic Beverage and Tobacco Control Division. In addition to severability and savings clause provisions, PL 15-115 contained the following: Section 1. Short Title. This Act may be cited as the “The Alcoholic Beverage Control Amendments Act of 2007.” Section 2. Findings and Purposes. The Legislature finds that the exist- ing Alcoholic Beverage Control Act does not provide any provisions for wine, beer, or other alcoholic beverages tasting or sampling for on-sale or off-sale licensees. Therefore, the purpose of this act is to provide for con- trolled procedures for conducting alcoholic beverage sampling… . Section 8. Regulations. Within 60 days after the enactment of this Act, the Secretary of Commerce shall promulgate rules and regulations neces- sary to carry out the intent of this Act. Public Law 16-44, enacted on August 14, 2009, contained severability and savings clause provisions and the following: Section 1. Findings and Purposes. The Legislature finds that Public Law 15-115 needs clarification as indicated by regulations promulgated with respect to Alcohol Beverage Sampling. It is the intent of the legisla- ture to decrease the bureaucratic burdens placed upon the licensees con- ducting the sampling. Therefore, the purpose of this legislation is to amend the provisions for controlled procedures for conducting alcoholic beverage sampling… . Section 3. Regulations. No further rules or regulations are necessary to carry out the intent of this legislation.
