§ 7107. Enforcement

TITLE 9: VEHICLE CODE DIVISION 7: SERIOUS TRAFFIC OFFENSES AND PENALTIES § 7107. Chemical and Other Tests. (a) Upon the trial of any civil or criminal action or proceeding arising out of acts alleged to have been committed by any person while driving or in actual physical control of a vehicle while under the influence of alcohol or drugs, evidence of the concentration of alcohol or drugs in a person’s breath at the time alleged, as determined by analysis of the person’s breath, shall be admissible. (b) Upon the request of the person who submits to the test at the request of a police officer, full information concerning the test shall be made available to him or his attorney. (c) If a person under arrest refuses to submit to the test under the provisions of 9 CMC § 7106, evidence of refusal shall be admissible in any civil or criminal action or proceeding arising out of acts alleged to have been committed while the person was operating or in actual physical control of a motor vehicle while under the influence of alcohol or drugs.
