§ 2118. Schedule III- Controlled Substances Included
TITLE 9: VEHICLE CODE DIVISION 2: REGISTRATION AND LICENSES § 2118. Disposition of 9 CMC § 2202 Fees and Penalties. (a) Distribution of 9 CMC § 2202(b) license fees. Notwithstanding any CNMI law or regulation to the contrary, all fees collected for obtaining a license pursuant to 9 CMC § 2202(b), including the learner’s permit fee and the temporary driver’s license fee, shall be distributed as follows: 45% for the operations and programs of the Bureau of Motor Vehicles, 45% for road maintenance and for the upkeep and maintenance of road shoulders by the Department of Public Works, and 10% to the upkeep and maintenance of street lights by the Commonwealth Utilities Corporation. (b) Distribution of 9 CMC § 2202(d) and (e) penalties. Notwithstanding any CNMI law or regulation to the contrary, the penalties paid pursuant to 9 CMC § 2202(d) and (e), for violations of 9 CMC § 2202(a) and (c) respectively, shall be distributed as follows: the Secretary of the Department of Public Works shall be the expenditure authority of 45% for road maintenance and the upkeep and maintenance of road shoulders by the Department of Public Works. The remaining 55% shall be distributed as follows, 45% for the operations and programs of the Bureau of Motor Vehicles, and 10% to the upkeep and maintenance of street lights by the Commonwealth Utilities Corporation. (c) Notwithstanding any CNMI law or regulation to the contrary, the fees collected shall be deposited into a revolving fund account as provided for herein for the respective agencies’ accounts, and any unused funds at the end of a fiscal year shall not lapse and shall be available without fiscal year limitation. Said funds shall not be reprogrammed or transferred back into the general fund, or any other account. Source. PL 20-39 § 3, (Jan. 26, 2018), modified. Commission Comments: The Commission corrected citations in (a) and (b) for conformity, and inserted a comma after “Public Works” in (a) and after “(e)” in (b) pursuant to 1 CMC § 3806(g). The Commission changed capitalization in (a) and (b) for the purpose of conformity pursuant to 1 CMC § 3806(f).
