§ 253. Defenses- Infancy

TITLE 6: CRIMES AND CRIMINAL PROCEDURE GENERAL PROVISIONS § 253. Defenses: Infancy. Children under the age of 10 are conclusively presumed to be incapable of committing any crime. Children between the ages of 10 and 14 are also conclu- sively presumed to be incapable of committing any crime, except the crimes of murder and rape, in which case the presumption is rebuttable. The provisions of this section, however, do not prevent proceedings against and the disciplining of any person under 18 years of age as a delinquent child. Source: 11 TTC § 6.
